Volunteer Release and Waiver of Liability Form

This Volunteer Release and Waiver of Liability Form (this “Release”) to the United Way of the Brown County Area (“Nonprofit”), a nonprofit corporation organized and existing under the laws of the State of Minnesota, and each of its directors, officers, employees, agents, successors, and assigns. Volunteer desires to provide volunteer services for Nonprofit and engage in activities related to serving as a volunteer. Volunteer understands that the scope of Volunteer’s relationship with Nonprofit is limited to a volunteer position and that Volunteer will not be an employee of Nonprofit; that no compensation is expected in return for services provided by Volunteer; that Nonprofit will not provide any benefits traditionally associated with employment to Volunteer; and that Volunteer is responsible for his/her own insurance coverage in the event of personal injury or illness as a result of Volunteer’s services to Nonprofit.
 

  1. Waiver and Release: Volunteer and Volunteer’s heirs release and forever discharge and hold harmless Nonprofit and its directors, officers, employees, agents, successors, and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from the services Volunteer provides to Nonprofit, except for any personal injury, death, or damage to personal property caused by Nonprofit’s intentional, willful, or wanton acts. Volunteer understands and acknowledges that this Release discharges Nonprofit from any liability or claim that Volunteer may have against Nonprofit with respect to bodily injury, personal injury, illness, death, or property damage that may result from the services Volunteer provides to Nonprofit or occurring while Volunteer is providing volunteer services, except for any personal injury, death, or damage to personal property caused by Nonprofit’s intentional, willful, or wanton acts.
     
  2. Insurance: Volunteer understands that Nonprofit does not assume any responsibility for or obligation to provide Volunteer with financial or other assistance, including, but not limited to, medical, health, or disability benefits or insurance. Volunteer expressly waives any such claim for compensation or liability on the part of Nonprofit beyond what may be offered freely by Nonprofit in the event of injury or medical expenses incurred by Volunteer. If Volunteer operates a motor vehicle while volunteering for Nonprofit, Volunteer represents that Volunteer carries motor vehicle insurance in at least the amounts required under Minnesota law.
     
  3. Assumption of Risk: Volunteer understands that the services Volunteer provides to Nonprofit may include activities that may be hazardous to Volunteer or involve inherently dangerous activities. Volunteer agrees to act with great care for Volunteer’s safety and well-being and that of all other people and property around Volunteer while volunteering. Volunteer is participating in volunteer activities at his or her own risk, and Volunteer expressly accepts full responsibility for all of the risks, known or unknown, of Volunteer’s participation. Volunteer’s participation is purely voluntary, and Volunteer elects to participate in spite of the risks.
     
  4. Costs and Attorneys’ Fees. Volunteer agrees that should Nonprofit or its directors, officers, employees, agents, successors, or assigns be obliged to enforce this Release and the promises Volunteer has made in it or to defend against an action brought by Volunteer notwithstanding this Release, Volunteer agrees to indemnify Nonprofit and its directors, officers, employees, agents, successors, and assigns against, and hold Nonprofit and its directors, officers, employees, agents, successors, and assigns harmless from, the same, and to reimburse Nonprofit and its directors, officers, employees, agents, successors, and assigns for all related attorneys’ fees, discovery, and other litigation costs.
     
  5. Photographic Release: Volunteer grants and conveys to Nonprofit all right, title, and interests in any and all photographs, images, videos, or audio recordings of Volunteer or Volunteer’s likeness or voice made by Nonprofit in connection with Volunteer’s provision of volunteer services to Nonprofit and consents to Nonprofit’s publication of any such photographs, images, videos, or audio recordings.
     
  6. Other: Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Minnesota and that this Release shall be governed by and interpreted in accordance with the laws of the State of Minnesota. Volunteer agrees that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.

By signing below, Volunteer expresses his or her understanding and intent to enter into this Release willingly and voluntarily. This Release shall continue in full force and effect until affirmatively revoked in writing by Volunteer.

I am the parent or guardian of the Volunteer. I understand fully that by signing this document, I am waiving the legal rights of Volunteer and myself both to assert certain claims against Nonprofit and its directors, officers, employees, and agents, successors, and assigns. I fully understand the consequences of this Release. I have read the Release in its entirety, I understand the content and implications of the document, I sign this Release freely and voluntarily, and I agree to be legally bound by the terms and conditions of this Release.
